Terms & Conditions
These Terms & Conditions govern your use of Talksy Photo, operated by Abi River Applications (ABN 26 210 733 764), a sole trader registered in Queensland, Australia. By using the service you agree to these terms.
1. The Service
Talksy Photo is an Augmentative and Alternative Communication (AAC) application that allows users to build personalised communication libraries using photos, videos, drawings, and symbols. It is provided as a web application at talksyphoto.com.
2. Accounts & Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to register for an account. Talksy Photo is designed to be set up and managed by an adult — a parent, guardian, carer, or support worker — on behalf of themselves or a person in their care, who may be a child or an adult with communication needs. As the account holder you are responsible for all use of the account, including any person you set it up for.
You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information when registering.
3. Subscription Plans & Pricing
Talksy Photo is offered on the following plans:
- Free: Access to the core communication library with a limit of 50 photos/drawings and 100 emoji items. Video recording and upload is not available on the free plan.
- Personal Monthly: AUD $9.00 per month — unlimited personal items, video recording and upload, and full access to all features.
- Personal Yearly: AUD $90.00 per year — same as monthly, billed annually.
All prices are in Australian Dollars (AUD) and include applicable taxes. Subscriptions renew automatically at the end of each billing period unless cancelled.
4. Payment
Payments are processed securely by Stripe. By subscribing you authorise Stripe to charge your payment method on a recurring basis. You can manage or cancel your subscription at any time through the billing portal in Settings.
5. Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until that date. Refunds are assessed on a case-by-case basis. To request a refund contact us at talksy@abiriverapps.com.
6. Promo Codes & Lifetime Access
Promotional codes and lifetime access codes are issued at our discretion, are non-transferable, and may not be combined with other offers. We reserve the right to limit or withdraw promotional offers at any time.
7. Your Content
You retain ownership of all content you upload to Talksy Photo (photos, videos, drawings, captions). By uploading content you grant us a limited licence to store and display it for the purpose of providing the service to you. We do not use your content for any other purpose.
8. Acceptable Use
You agree not to use Talksy Photo to upload unlawful, harmful, or infringing content; to attempt to gain unauthorised access to any part of the service; or to use the service in any way that could damage, disable, or impair it.
9. Availability & Changes
We aim to keep Talksy Photo available at all times but do not guarantee uninterrupted access. We may update, modify, or discontinue features with reasonable notice. We will not materially reduce the core functionality of a paid plan without offering a refund for the remaining period.
10. Limitation of Liability
To the maximum extent permitted by Australian law, Abi River Applications is not liable for any indirect, incidental, or consequential loss arising from your use of Talksy Photo. Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim.
11. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
12. Governing Law
These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
13. Updates to These Terms
We may update these Terms & Conditions from time to time. Continued use of the service after changes are posted constitutes your acceptance of the updated terms.
